Itemizeit uses software, automated analysis, and other tools to help consumers understand medical bills, identify billing information that may deserve further review, prepare billing-related communications, and manage medical billing disputes.
Itemizeit does not provide medical advice, legal advice, clinical advice, insurance coverage determinations, or guarantees regarding the accuracy of a provider’s billing, the outcome of a dispute, or the amount a customer may save.
Please review Section 4 “Understanding What Itemizeit Does and Does Not Do” for additional information.
By accessing or using any Itemizeit website, account portal, bill-review tool, document-generation feature, advocacy service, communication service, or other product or service we provide (collectively, the “Services”), you agree to be bound by these Terms of Service.
Itemizeit is operated by HMH Holdings LLC d/b/a Itemizeit (“Itemizeit,” “we,” “us,” or “our”).
If you do not agree to these Terms, do not use the Services.
You must be at least 18 years old and legally capable of entering into a binding agreement to use Itemizeit.
If you submit information concerning another individual, you represent that you are legally authorized to act for that person or to provide the information to Itemizeit.
Itemizeit provides technology-enabled medical bill review and consumer billing advocacy services. Depending on the service or package selected, Itemizeit may:

Itemizeit personnel do not act as independent financial brokers, debt adjusters, or settlement agents, and will not independent of your explicit, contemporaneous direction engage in balance-reduction or settlement discussions with creditors.

A finding from Itemizeit means that the information may deserve further review or clarification. It does not automatically establish that the charge is incorrect.
Itemizeit uses automated technologies, which may include artificial intelligence, document processing, mathematical validation, structured-data analysis, and rule-based systems. These technologies help organize and review information contained in medical billing documents.
Automated systems are not infallible. Documents may contain unclear text, unusual formatting, missing pages, incomplete information, or other conditions that affect an analysis. You should review your results and the information extracted from your documents before relying on it or sending communications based on it. Itemizeit may allow you to correct information extracted from a document when necessary.
A finding identified by Itemizeit is intended to help you determine what may be worth questioning or reviewing. A finding does not necessarily establish:
Where Itemizeit displays an amount that may be worth reviewing, that amount represents the financial amount associated with the supported billing issue identified by the system. It is not guaranteed savings or a guaranteed refund.
You are responsible for:
Using Itemizeit does not automatically suspend a medical bill, collection activity, insurance requirement, provider deadline, or other obligation.
Certain features require an Itemizeit account. You agree to:
You may not access or attempt to access another customer’s account, case, documents, or information.
You retain ownership of medical bills, records, communications, and other materials you provide to Itemizeit. By submitting information to Itemizeit, you authorize us to process that information as reasonably necessary to provide the Services you request. This may include securely transmitting information to service providers that perform functions necessary to operate Itemizeit. You represent that you have the legal right to provide any information or documents you upload. You may not knowingly upload another person’s medical or billing information without appropriate authorization.
Some Itemizeit Services require you to provide electronic authorization before we communicate with another party or take action relating to your case. An authorization may include your name, electronic signature, date and time of signature, account and case information, email verification, IP address, device or browser information, authorization version, and other information necessary to maintain an audit trail.
By intentionally signing, checking an authorization box, entering a verification code, or selecting a button indicating your agreement, you agree that the action may serve as your electronic signature where permitted by law. Federal law generally recognizes electronic signatures and electronic records when applicable requirements are met.
Certain Services allow Itemizeit to prepare or send communications concerning your medical billing matter. When you authorize Itemizeit to send a communication, you authorize us and our applicable service providers to transmit the approved information to the identified recipient. This may include communications with healthcare providers, hospitals, medical practices, billing departments, health insurers, claims administrators, and other organizations involved in your billing matter.
You remain responsible for reviewing communications before approval where the Service provides an approval step.
When Itemizeit transmits communications or when an Itemizeit advocate contacts a third party on your behalf, Itemizeit acts solely as a communication conduit and clerical assistant for a self-represented consumer. You retain complete legal control and ownership over the dispute. Itemizeit will not enter into any binding settlement, discount agreement, or payment accommodation without your express, written, final approval. The third party will be explicitly notified that Itemizeit is assisting you in an administrative capacity only.
Itemizeit offers free and paid Services. Current pricing and the features included with each package will be displayed before purchase. By purchasing a paid Service, you authorize Itemizeit and its payment processor to charge the payment method you provide for the amount displayed at checkout. Unless specifically stated otherwise, payment for a one-time Itemizeit Service does not create a recurring subscription. Additional third-party costs, such as mailing charges, may be disclosed separately where applicable.
Any applicable refund policy, guarantee, or other purchase condition will be disclosed with the applicable offer. A refund does not require Itemizeit to delete records that we are legally or operationally required to retain.
If you provide a telephone number and consent to receive text messages, Itemizeit may send messages concerning account activity, case updates, document status, action reminders, communication status, security notifications, and customer support. Message frequency varies based on account and case activity. Message and data rates may apply. You may opt out of non-essential SMS communications by replying STOP where supported. For assistance, reply HELP where supported or contact hello@useitemizeit.com. Certain essential account or security communications may continue through other permitted channels.
You may use Itemizeit for legitimate personal medical billing review and advocacy purposes. You may upload your medical billing documents, review your billing analysis, create and manage your cases, generate documents made available through your purchased Service, use generated documents for your own medical billing matter, and authorize Itemizeit to communicate concerning your case where supported.
You may not:
The Itemizeit platform, software, algorithms, workflows, user interface, branding, designs, analysis systems, reports, templates, content, and other proprietary materials are owned by HMH Holdings LLC or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of Itemizeit’s intellectual property to you. Documents generated specifically for your case may be used by you for the medical billing matter for which they were generated.
Our collection and use of personal information and consumer health information are governed by our Privacy Policy, which is incorporated into these Terms. Itemizeit handles information that may include sensitive medical and billing information. Depending on the circumstances and relationships involved, consumer-directed health applications may be governed by privacy requirements outside HIPAA as well as HIPAA requirements in certain business relationships. The FTC’s Health Breach Notification Rule also applies to certain health apps and related consumer health technologies. Our Privacy Policy explains our privacy practices in greater detail.
Itemizeit uses third-party service providers to operate portions of the Service. Depending on the features you use, these providers may perform functions involving hosting and infrastructure, artificial-intelligence processing, email delivery, SMS communications, postal mailing, mail receipt, payment processing, document processing, and security and monitoring. Use of those providers may also be subject to their respective terms, privacy practices, contractual protections, and service limitations. Itemizeit selects and configures providers based on the requirements applicable to the services they perform.
We work to maintain reliable access to Itemizeit but do not guarantee uninterrupted availability. The Service may occasionally be unavailable because of maintenance, software updates, third-party service interruptions, internet outages, security events, technical problems, or circumstances outside our reasonable control. We may modify or discontinue features when reasonably necessary.
ITEMIZEIT DOES NOT GUARANTEE A PARTICULAR BILLING OUTCOME OR FINANCIAL RESULT.
We do not guarantee that every billing issue will be detected, every finding will result in a correction, a provider will respond, an insurer will change its determination, a bill will be reduced, a refund will be issued, a customer will save a particular amount of money, or that every document or third-party record will contain complete or accurate information. Actual outcomes depend on the facts of each case and the actions of third parties outside Itemizeit’s control.
To the maximum extent permitted by applicable law, Itemizeit and its Services are provided “as is” and “as available.” We disclaim warranties not expressly provided in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent those warranties may lawfully be disclaimed. Nothing in these Terms limits consumer rights that cannot legally be waived.
To the maximum extent permitted by applicable law, Itemizeit, HMH Holdings LLC, and their officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Services. This includes, where legally permitted, losses resulting from decisions made based on incomplete or inaccurate billing information, provider or insurer decisions, missed deadlines, financial losses, third-party service interruptions, loss of data, or unauthorized use caused by a user’s failure to protect account credentials.
To the maximum extent permitted by applicable law, Itemizeit’s aggregate liability relating to a paid Service will not exceed the amount you paid Itemizeit for the Service giving rise to the claim. Nothing in this section excludes liability that cannot lawfully be excluded.
To the extent permitted by law, you agree to indemnify and hold harmless HMH Holdings LLC, Itemizeit, and their officers, employees, agents, contractors, and affiliates from claims arising from your unlawful use of the Services, information or documents you knowingly submit without authority, your violation of these Terms, your infringement of another person’s rights, or fraudulent or intentionally false information submitted through your account.
We may suspend or restrict an account when reasonably necessary to protect customers, protect sensitive information, investigate suspected fraud, respond to a security incident, prevent unlawful activity, or enforce these Terms. You may stop using Itemizeit at any time. Termination does not automatically eliminate obligations or records that must reasonably remain for transaction, authorization, security, dispute-resolution, or legal purposes.
We may update these Terms to reflect changes to Itemizeit, applicable law, technology, or our Services. The date at the top will show when the Terms were most recently updated. If we make material changes, we may provide additional notice through Itemizeit, email, or another reasonable method. Your continued use of the Services after updated Terms become effective constitutes acceptance where permitted by law.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any court proceeding properly brought in Nevada relating to these Terms will be brought in an appropriate state or federal court located in Clark County, Nevada, unless applicable law requires a different venue.
These Terms and the Itemizeit Privacy Policy, together with any additional terms specifically presented for a particular Service, constitute the agreement between you and Itemizeit concerning your use of the Services.
If any provision is determined to be unenforceable, the remaining provisions will remain in effect.
Failure to enforce a provision of these Terms does not waive our right to enforce it later.
You may not assign your rights under these Terms without our consent. Itemizeit may assign its rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, or similar business transaction.
